Q: When can a person apply for South African citizenship?
A: A person with a South African permanent residence visa qualifies to apply for South African citizenship through naturalization after residing in South Africa for five or more years while being a permanent resident. Any person married to a South African citizen qualifies for naturalization two years after receiving his or her South African permanent residence visa issued at the time of the marriage. A person under 21 years old, who has obtained South African permanent residence qualifies for naturalization immediately after the visa has been issued.
Q: Can I be able to work on a Spousal Visa?
A: One can qualify to apply for a Spousal visa with Work Authorization in terms Section 11(6) of the Immigration Act, 2002, as amended and one of the requirements for the application will be that you will have to be legally married to a South African citizen or a permanent residence holder and an employment offer from a South African company.
Q: Can I qualify for a Critical Skills Visa?
A: In order to qualify, the applicant must ensure he/she falls under the Critical Skills category before applying for a visa or permit. Also the must be able to proof that they fall within the current critical skills category by specifically indicating the occupation/critical skill for which the application is being made. The occupation/critical skill must be on the Critical Skills list and a fixed term contract of employment must accompany the application signed by both parties.
Q: How long is a Study Visa issued for?
A: Study Visas issued for studies at higher education and training institution shall be issued for duration of the course, but not exceeding four years and visas issued for studies at school shall be valid for the duration of the studies; provided that the duration for studies at the primary school shall not exceed eight years and for secondary school shall not exceed five years.
Q: Can I still be able to apply for a ZEP Waiver?
A: Yes you can, however you will need to have a copy of the applicant's curriculum vitae & job description. A readable copy of the applicant's passport and all temporary residence permits affixed therein. A copy of the employment contract stipulating the terms and conditions and signed by both the employer and the employee. Once the waiver is issued then you will be able to proceed and apply for a General Work Visa.
